The OZERTY-FRANCE site is owned and published by the company MOJO FZ-LLC (hereinafter "OZERTY").
OZERTY takes respect for privacy and the protection of personal data very seriously and undertakes to implement adequate measures to ensure the protection of such data and to process and use such data in compliance with applicable provisions, in particular European Regulation 2016/679 of April 27, 2016 (GDPR) and Law No. 78-17 of January 6, 1978 known as the French Data Protection Act.
ARTICLE 1: Data controller
Your data is collected by OZERTY (MOJO FZ-LLC), a limited liability company whose registered office is located at A4-709 Building no. A4, Al Hamra Industrial Zone-FZ, 10055 Ras Al Khaimah, United Arab Emirates, and registered with the Ras Al Khaimah Trade and Companies Registry under number 45000044.
Within the meaning of Article 24 of the General Data Protection Regulation 2016/679 of April 27, 2016, OZERTY acts as data controller.

ARTICLE 2: Data collected, purposes and legal bases
OZERTY, as data controller, is required to collect, consult, use, modify, store, transmit and delete personal data in the context of its commercial and contractual activities.
In accordance with Article 4 of the General Data Protection Regulation 2016/679 of April 27, 2016, the terms "Data" or "Personal Data" designate any information relating to an identified or identifiable natural person (hereinafter referred to as the "Data Subject").
An "identifiable natural person" means a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more specific elements specific to their physical, physiological, genetic, psychological, economic, cultural or social identity.
OZERTY undertakes to collect personal data only for specific, explicit and legitimate purposes and not to subsequently process this data in a manner incompatible with these purposes.
OZERTY undertakes to process only personal data which is adequate, relevant and not excessive in relation to the purposes for which it is collected.
This data is mostly collected directly from the persons concerned when they:
- Create a personal account on the OZERTY Website.
- Make a request for information to OZERTY.
- Place an order on the Website.
- Browse the Website and/or consult the products.
- Contact OZERTY Customer Service.
As part of the collection activities mentioned above, OZERTY collects the following data:
- Identity data (last name, first name, and, where applicable, gender, age, date of birth).
- Contact data (email, postal address, telephone number, social network details).
- Billing data and payment terms.
- Details of the services and subscriptions subscribed to.
- The history of the contractual relationship.
- A copy of the individuals' correspondence with customer service.
- Where applicable, responses to surveys and questionnaires and comments/reviews.
- Technical information related to browsing (e.g. IP address, browsing history, visit route, browser, operating system, information on the devices from which you visit the website, etc.).
It is specified that some of this data, in particular gender, age or date of birth, is not systematically collected; it is collected only where applicable, when this is necessary for a specific purpose (for example for advertising measurement and optimization purposes). OZERTY reserves the possibility of collecting it for this purpose in compliance with the principles set out in this policy.
In order to better understand the data processing carried out by OZERTY, we inform the persons concerned that OZERTY may process their data for the following purposes, each based on a legal basis within the meaning of Article 6 of the GDPR:
- Carrying out processing relating to administrative management (customer accounts, orders, deliveries, invoicing, collection). Legal basis: performance of the contract concluded with the data subject (Article 6.1.b of the GDPR) and compliance with legal obligations, in particular accounting and tax obligations (Article 6.1.c of the GDPR).
- Carrying out processing relating to customer relationship management (review management, satisfaction surveys, loyalty program management). Legal basis: performance of the contract (Article 6.1.b) and/or OZERTY's legitimate interest in improving its products and services and building customer loyalty (Article 6.1.f).
- Carrying out processing relating to the management of complaints (after-sales service, processing of requests for rights of access, rectification, objection, erasure, management of disputes). Legal basis: compliance with a legal obligation (Article 6.1.c) and OZERTY's legitimate interest in defending its rights (Article 6.1.f).
- Carrying out processing relating to the management of marketing activity and improvement of the Site (traffic analysis, customer targeting, commercial prospecting, etc.). Legal basis: the data subject's consent where required, in particular for the placement of certain cookies and the sending of electronic communications (Article 6.1.a), and/or OZERTY's legitimate interest in promoting and improving its services (Article 6.1.f).
ARTICLE 3: Data hosting and transfers
Personal data is hosted and processed within the European Union as well as in countries recognized by the European Commission as ensuring an adequate level of data protection.
Where certain data is processed or accessed outside the European Union, such transfer is governed by the appropriate safeguards provided for in Chapter V of the GDPR, in particular the standard contractual clauses adopted by the European Commission, supplemented where applicable by additional measures intended to ensure an adequate level of data protection. ARTICLE 4: Recipients of the Data collected
Your data is intended for OZERTY. It may be communicated to our service providers acting as processors for the needs of the Service (in particular hosting of the Site, payment processing, delivery of orders, sending of communications and audience measurement), who act only on our instructions and are not authorized to use it for other purposes. Apart from these cases, OZERTY does not transmit your data to third parties.
ARTICLE 5: Data retention period
Data is kept for a period adapted to the purposes of the processing and in accordance with the legislation and regulations in force.
Data relating to the customer relationship is kept for the entire duration of the contractual relationship, then in an active database for up to three (3) years from the last contact from the data subject or from the end of the contractual relationship, in accordance with the recommendations of the CNIL.
At the end of this period, data necessary for the establishment, exercise or defense of legal claims may be archived, with restricted access, for the applicable limitation period. Accounting documents and supporting records (in particular invoices) are kept for ten (10) years from the close of the financial year, pursuant to Article L123-22 of the French Commercial Code.
Data processed on the basis of consent (in particular for prospecting purposes or via certain cookies) is kept until consent is withdrawn, and at most for the periods indicated in Article 7 with regard to cookies.
ARTICLE 6: Your rights
In accordance with the General Data Protection Regulation 2016/679 of April 27, 2016, each person has a right of access, rectification, erasure and portability of their Personal Data, and a right to restriction of and objection to the processing of this data. Where processing is based on consent, the data subject also has the right to withdraw their consent at any time, without this withdrawal affecting the lawfulness of the processing based on consent carried out prior to it.

ARTICLE 7: Cookie management policy
A Cookie is a text file placed on your hard drive by the server of the OZERTY Website. It generally contains the name of the server that placed it, an identifier in the form of a unique number and an expiration date. Its purpose is to collect information relating to your browsing in order to offer you services adapted to your terminal (computer, mobile, or tablet).
