ARTICLE 2: Acceptance of the general conditions of use
These GTC govern Users' access to the Subscribed Service offered on the Site (Ozerty No Limit). Subscribing to the service means accepting the General Conditions of Use of the Service described here.
Any registration and/or subscription to free or paid Services, as the case may be, implies the unreserved acceptance by the User of the provisions of the General Terms and Conditions, which he expressly acknowledges having read, understood and accepted beforehand.
Subscription is done through a checkbox when the User makes a purchase for the first time (“Subscribe to Ozerty No Limit”).
The current version of the GTC is available at any time and freely accessible on the Site. OZERTY may modify the GTC at any time depending on certain technical, economic, legal or commercial constraints, such as the launch of new services.
Users are informed of changes to the T&Cs within a reasonable time. Where applicable, they are informed when they log in to the new T&Cs in force and must accept them to continue to benefit from the Services.
Failing this, the User may unsubscribe, this unsubscription taking effect upon receipt of the User's last order for any order placed before the modification of the GTC.
Any derogation from the GTC, to be valid and enforceable against OZERTY, must be the subject of a written document signed by OZERTY and the User and expressly referring to the GTC.
OZERTY reserves the right to suspend any subscription or to immediately cease its Services for the benefit of a User, in particular if it violates a provision of the T&Cs.
A printed version of the T&Cs and any information sent electronically will be admissible in any legal proceedings concerning the application of these T&Cs, in the same manner and under the same conditions as any other written document kept in paper format.
The fact that OZERTY does not exercise, at a given time, a prerogative recognized by these GTC, or does not require the execution of any stipulation of the agreement resulting from said GTC may not under any circumstances be interpreted, either as a modification of the contract, or as an express or tacit waiver of the right to exercise said prerogative in the future, or of the right to require the scrupulous execution of the commitments made herein.
In the event of non-acceptance of the General Terms and Conditions stipulated in this contract, the User must waive the right to benefit from the service subscribed to on the site.
ARTICLE 3: The subscription
By subscribing to Ozerty No Limit, the subscriber agrees to pay €0.25 per day (paid €29.99 every 4 months). In return, the subscriber unlocks a 40% discount on the entire site (cumulative with any discounted price on the site), free standard shipping all year round and dedicated priority customer service. As long as the subscription is active, the subscriber will benefit from the benefits. If the subscription ends, the benefits are lost until the subscription is active again.
ARTICLE 4: Free trial
When subscribing to the service, the subscriber benefits from 6 (six) days of free use of the entire service, after which, unless the subscriber explicitly requests cancellation of the service, the service must be paid for.
ARTICLE 5: Payment
At the end of the free trial, a charge of €29.99 will be charged to your preferred payment method. In the event of a delay in accepting the payment, a failed payment or any circumstance preventing the payment from going through, the subscription will end immediately and all benefits will be lost.
ARTICLE 6: Cancellation
The subscription is a non-binding service. It can be interrupted at any time. The subscriber can request the cancellation of the subscription at any time by requesting cancellation by email to contact@ozerty-france.com.
If less than 30 days have passed between the last payment and the cancellation request, and the subscriber has not used any of their benefits, a full refund of the last payment may be requested.
If a benefit is used within the first 30 days, the first month is used up and cannot be refunded, only the remaining period of the month can be refunded.
After the first 30 days, the subscriber can request a refund for the remaining period of the subscription. Any month started is an expired month and cannot be refunded. For example, if after 33 days the subscriber wishes to stop his subscription, he can request a refund of €0.25 x 87 days: €21.75.
If a cancellation request is received by email, any new payments that may occur after the date will be refunded automatically.
All refunds will be made within 14 business days maximum.
ARTICLE 7: Modifications to the CGS
OZERTY reserves the right to modify these conditions at any time. Any modification will be notified at least 30 days before its entry into force, to the subscriber. If the subscriber does not accept the new GTC, he can request the cancellation of the subscription by following the procedure above.
ARTICLE 8: Limits of liability
The Service is provided "as is" and "as available" without warranty of any kind.
OZERTY cannot be held responsible for the unavailability of a product, or if the product purchased does not meet the subscriber's expectations.
ARTICLE 9: Personal data
By subscribing to Ozerty No Limit, the subscriber hereby agrees to OZERTY's use of personal data in accordance with the site's privacy policy.
ARTICLE 10: Applicable law
These T&Cs are governed by French law.
Any claim must be sent within a maximum period of thirty (30) days after the execution or the expected date of execution of the Service subscribed to by the subscriber to the following address:
contact@ozerty-france.com
In the absence of an amicable resolution of a dispute between the parties, the courts of France will have exclusive jurisdiction to hear it.
