Please read these Conditions carefully before subscribing to the VIP Program. By completing your subscription, you confirm that you have read, understood and accepted them.

Article 1: Definitions and key information

To make these Conditions easier to read, the essential terms and information are summarised below.

Article 2: Acceptance of the conditions

Subscription to the VIP Program takes place at checkout, by adding the VIPWELCOME5 offer to your order using the "Apply offer" button. This offer gives you a 5% discount on your order, a €5 credit for a future order, and activates your VIP subscription.

By adding this offer and then confirming your payment, you acknowledge that you have read, understood and accepted these Conditions, which form a contract binding the Member and the Company from the moment of subscription.

The Company may modify these Conditions. Any substantial modification is communicated by email at least 30 days before it comes into force. If you do not accept the modifications, you may cancel your subscription before they take effect, in accordance with Article 7.

Article 3: Description of the VIP Program

The VIP Program is a recurring subscription offering active Members:

  • at the time of subscription, via the VIPWELCOME5 offer: a 5% immediate discount on the subscription order and a welcome credit of €5, usable from €20 of order value and valid for as long as the subscription is active;
  • a recurring credit of €40 credited for each billing cycle paid, usable from €20 of order value;
  • access to member-only promotions, priority customer service, and other benefits that may be introduced.

Conditions applicable to store credits:

  • they are granted as a commercial benefit, are personal, have no monetary value, and can neither be converted into cash nor refunded; they apply to the price of eligible products only, and do not cover delivery costs or other services;
  • the cycle credit is granted after each successful payment and accumulates on the account; unused credits are retained for as long as the subscription remains active;
  • they may be combined with other promotional offers on the Site;
  • the minimum order amount to use a credit is €20.

Important: benefits are only available for as long as your subscription is active. In the event of cancellation, or of cancellation for non-payment, all unused credits are immediately and permanently lost.

Article 4: Free trial

Every new Member benefits from a 28-day free trial upon their first subscription, with access to all VIP benefits, including the welcome credit and the cycle credit.

If you cancel during the free trial, your benefits cease immediately and no amount is charged.

At the end of the 28 days, and unless you cancel before that date, the subscription becomes paid and your payment method is charged €30. A reminder email is sent to you before this first charge.

Article 5: Fees and billing

5.1 Fees. The subscription is €30 per 28-day cycle. All prices are indicated in euros (€).

5.2 Billing cycle. The subscription is charged on a rolling 28-day cycle, beginning at the end of the free trial. Subsequent charges occur automatically every 28 days. The cycle is 28 days and does not correspond to the calendar month.

5.3 Automatic renewal. By subscribing, you authorise the Company to charge the applicable fees to your registered payment method at each cycle, unless you cancel or skip a renewal in accordance with these Conditions.

5.4 Price stability. Fees do not change during a cycle. Any increase is notified to you by email at least 30 days in advance; you may cancel before it comes into force if you do not wish to continue at the new rate.

5.5 Payment method. Charges are made to the payment method used when you subscribed. You are responsible for the accuracy and validity of your payment information. The Company is not responsible for failed transactions resulting from inaccurate or expired payment information.

Article 6: Skipping a renewal

You may choose to skip an upcoming renewal, thereby avoiding the €30 charge and forgoing the corresponding €40 credit for that cycle.

You can access your account area via the "My account" button at the top of the site, or directly at https://secure.ozerty-france.com/portal. It is from this area that you can skip a renewal and cancel your subscription.

6.1 Deadline. The request must be submitted at least 7 days before the next charge date. Within the 7 days preceding the charge, the option remains displayed in your account area but can no longer apply to the imminent cycle; it will then apply to the following cycle.

6.2 How to do it. You can skip a renewal from your online account area, or by email at contact@ozerty-france.com. A confirmation is sent to you once the request has been processed.

6.3 Consecutive skipped renewals. You may skip several consecutive renewals, with no annual limit. Skipping a renewal does not cancel your subscription: it automatically resumes at the next cycle that is not skipped.

Article 7: Cancellation

You may cancel your VIP subscription at any time, with no minimum commitment period.

7.1 How to cancel. You may cancel online from your account area ("My account" button at the top of the site, Subscription section), or by email at contact@ozerty-france.com. Online cancellation takes effect immediately; requests by email are confirmed within 2 business days. Keep your cancellation confirmation.

7.2 Effect of cancellation. Cancellation takes effect immediately. Upon cancellation, access to all VIP benefits ceases and all unused store credits are immediately and permanently lost. No partial refund is granted for the remaining days of the current cycle, subject to the right of withdrawal (Article 8) and the refund policy (Article 9).

Article 8: Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, you have a period of 14 days from subscription to exercise your right of withdrawal, by means of an unambiguous statement sent to contact@ozerty-france.com.

During the free trial period, no amount is charged: you may cancel at any time free of charge. If you withdraw after a first charge and you have not used any store credit, the amount charged is refunded to you within 14 days to the original payment method. Store credits already used, as well as discounts already applied to an order, remain acquired and do not give rise to a refund.

Article 9: Refund policy

Beyond the legal right of withdrawal provided for in Article 8, and as a commercial gesture, the Company may grant the refund described below.

As a general rule, subscription fees are not refundable once a cycle has been billed. However, if you cancel without having used any VIP benefit (no discount and no store credit applied to an order) over the period concerned, you may request a refund of the corresponding payments made over the last 120 days.

Any benefit used, even partially, makes the cycle during which it was granted non-refundable. Likewise, credits already spent may under no circumstances be refunded.

To request a refund, contact contact@ozerty-france.com within 30 days of your cancellation and confirm that no benefit has been used over the periods concerned. Requests are reviewed on a case-by-case basis; approved refunds are processed within 14 days to the original payment method.

If you believe a charge has been made in error, contact our customer service at contact@ozerty-france.com within 7 days of the transaction date.

Article 10: Payment failure and suspension

In the event of an unsuccessful charge:

  • you are informed by email;
  • the Company automatically makes up to 3 further attempts over a period of 14 days;
  • if the payment remains unsuccessful after these attempts, your account is suspended and access to VIP benefits is immediately restricted;
  • failing regularisation within 14 days of the first failure, the subscription may be cancelled and unused credits are lost.

A suspended account can neither accumulate nor use store credits for the duration of the suspension.

Article 11: Suspension and termination by the Company

The Company reserves the right to suspend or terminate your subscription, with immediate effect and without notice, in any of the following cases:

  • breach of any of the provisions of these Conditions;
  • fraudulent, abusive or unlawful use of the Program or the Site;
  • provision of false or misleading information;
  • any behaviour likely to cause harm to the Company, to other Members or to third parties.

In the event of termination for fault, no refund is due and unused credits are permanently lost.

Article 12: Modification of the conditions

The Company reserves the right to modify these Conditions at any time. Any substantial modification is communicated to all active Members by email at least 30 days before it comes into force. If you do not accept the modified conditions, you may cancel your subscription before they take effect, in accordance with Article 7.

Article 13: Limitation of liability

To the extent permitted by applicable law, the Company cannot be held liable for indirect, incidental or consequential damages resulting from the Program, in particular loss of data, loss of profits or business interruption. The Program is provided "as is" and "as available"; the Company does not guarantee uninterrupted access, nor the permanent availability of any particular product or offer. This clause does not limit the Company's liability in cases where the law prohibits it, nor does it affect legal guarantees of public policy.

Article 14: Personal data

By subscribing to the VIP Program, you consent to the processing of your personal data by MOJO FZ-LLC and its payment providers, in accordance with our Privacy Policy and in compliance with the General Data Protection Regulation (GDPR). You may exercise your rights at any time using the contact details in Article 16.

Article 15: Applicable law and dispute resolution

These Conditions are governed by French law.

In the event of a dispute, the parties will first endeavour to find an amicable solution by contacting customer service. Failing an amicable agreement, the consumer Member may refer the matter free of charge to the consumer mediator to which the Company is affiliated, namely AME CONSO, within one year from the written complaint (www.mediationconso-ame.com, or by post to AME CONSO, 197 Boulevard Saint-Germain, 75007 Paris).

The consumer Member retains the right to bring the matter before the competent French courts. No provision herein deprives the consumer of the mandatory protections of their country of residence.
